Instead, Kim’s legal team describes Musk as having directed xAI to comply with safety regulations and implement appropriate testing processes. The complaint targets Kim’s direct supervisor, xAI co-founder Jimmy Ba, who left the company earlier this year.
Ba is accused of ignoring Musk’s directives and retaliating against Kim for pushing for safety measures. The lawsuit quotes Ba as allegedly telling Kim, ‘AI will kill us all anyway,’ and claims Ba was primarily focused on making xAI the first to achieve superintelligence.
One of the more serious allegations involves an attempt to bypass European Union safety regulations. According to the complaint, in August 2025, Ba allegedly misrepresented aspects of the Grok Code 1 model to avoid legally required testing. ‘Mr. Ba indicated that he would rather release an unsafe model than a poor-performing one,’ the lawsuit states. ‘Mr. Musk ultimately had to intervene.’
The lawsuit arrives just days before SpaceX is expected to go public in what analysts predict will be the largest initial public offering in history. Kim’s departure from xAI in September 2025 came shortly after Grok made headlines for being used to flood X, Musk’s social media platform, with nonconsensual sexual imagery.
Kim’s background in AI safety predates his time at xAI. While working at Scale AI, he led a project producing training data to help AI systems detect harmful content and comply with governance policies. Last week, the nonprofit Center for AI Safety named Kim as its president.
